We limit the use of cookies, and in all cases, these cookies do not store personal information.

If we decide to materially change our Privacy Statement, we will post those changes through a prominent notice on the website.

We have implemented reasonable technical and organizational measures to secure your personal information from accidental loss and unauthorized access, use, alteration or disclosure. For Job Seekers

On internet Job Boards you post your resume which includes contact and often confidential information about yourself. Most job boards then sell your information over and over to companies and individuals that want to sell you something, want you to invest in a business opportunity or they want you to take a commission only position.

WorkGiant.com commits THAT YOUR INFORMATION WILL NEVER BE SOLD. IT WILL ONLY BE USED FOR THE PURPOSE OF ARRANGING EMPLOYMENT FOR YOU WITH LEGITAMTE EMPLOYERS. Should you ever be contacted for inappropriate reasons or feel that you have been misled by a member company please report this to WorkGiant so we may take appropriate action.

Your contact information is held confidential until you release it to a potential employer. Portions of your resume are searchable. Employers will view your resume and if interested they will forward you the job posting. If you are interested in the position you then release your contact information.

We attempt to limit access to our searchable resume database only to member companies but cannot guarantee that other parties will not gain access to this database. We are not responsible for the use made of resumes by third parties who access such resumes while they are in our searchable database.

All of today's top employment sites ask Job Seekers to "send this job to a friend", or to "recommend this job to your friend". But what's in it for you? Nothing! WorkGiant.com is not a public job board. We are a private Board designed to solve many of the challenges with the major online sites. Access is granted by invitation and acceptance by WorkGiant. Your adherence to this agreement will make the board work for all participants.

YOU MUST BE AUTHORIZED TO ACT ON BEHALF OF YOUR COMPANY:

First and foremost, in order for your company to sign up as a new member company of WorkGiant.com, you must be an authorized individual to act on behalf of and bind your company to the terms of this agreement.

WorkGiant.com grants companies (not individuals) membership by verifying their Federal Employer Identification Number (FEIN).

WorkGiant.com verifies companies are real through their unique FEIN. WorkGiant.com expects that only an authorized member of a company will be privy to this number. WorkGiant.com will never disclose this number to any outside parties for any reason. This number will only be used internally by WorkGiant.com for company member verification purposes.

Our clients only pay after they hire the qualified candidate of their choice. If a client company does not hire a candidate from the site, they DO NOT PAY! Again, we will only charge our clients when their open positions have been filled!

WorkGiant.com client companies are responsible for Jobs Posted on the Site and the consequences of their posting. WorkGiant.com is not obligated to screen or monitor Jobs Posted on the Site, however documents found to violate our Job Posting Rules may be investigated and removed at our discretion. WorkGiant.com does not represent or guarantee the truthfulness, accuracy, or reliability of Jobs Posted on the Site.

Job Posting Requirements

Job Postings Must:

· Contain an accurate salary range
· Should have sufficient information to describe the requirements and the nature of the job opportunity
· Should contain the specific qualifications required in order to get hired
· Commission only positions must be identified

Job Postings Cannot Contain:

· URLs or links back to your website or any other website for advertising purposes or links back to your website to redirect job seekers
· URLs or links that are irrelevant to the job
· References that encourages a job seeker to "email for more information"
· Irrelevant keywords that are visible or hidden
· Material that infringes on intellectual property rights of others, or violates the publicity or privacy rights of others
· Abusive, defamatory, embarrassing, harassing, harmful, hateful, invasive, libelous, obscene, racial, threatening, tortuous or vulgar wording
· Copyrighted material, unless you own the copyright or have the permission of the copyright owner
· Reveal trade secrets unless you own them or have permission of the owner to post them
· Post advertisements or solicitations of business for: Anything requiring a monetary investment by the WorkGiant.com Job Seeker
· Be posted by Agencies for the purpose of recruiting job seekers

CORRESPONDING OPEN POSITION(S):

As a client company when talking to a candidate found through the site about an open job requirement, you must have a corresponding open position posted on WorkGiant.com. In other words, companies are not allowed to redirect candidates found on WorkGiant.com to open positions that are not posted on WorkGiant.com.

RESUMES:

Using the WorkGiant.com Resume Database is strictly for employers who are in search of candidates. Sending unsolicited mail or Email, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services is strictly prohibited. Resume Database information is not for resale or to be used to promote products or services of any kind.

JOB SEEKERS:

TERMS AND CONDITIONS:
This page states the "Terms and Conditions" under which you may use WorkGiant.com. Please read this page carefully. As a Job Seeker, if you do not accept these Terms and Conditions or you do not meet or comply with their provisions, you may not use the Site. Please note, WorkGiant.com may revise these Terms and Conditions at any given time based on our discretion. Please review our Terms and Conditions periodically for any such revisions.

ACCOUNT STATUS:
WorkGiant.com may immediately issue a warning, suspend or terminate your access to the Site for breach of this Agreement, or if we are unable to verify or authenticate any information you provide to us, or for any other reason at our discretion.

JOB SEEKERS SIGN UP:
It is up to our Job Seekers to enter valid information I.E. name, address, email, phone, fax, work history, education, etc.

PASSWORD CONFIDENTIALITY:
You are responsible for maintaining the confidentiality of your password and account number.

EMPLOYER PAYMENT FOR SERVICES:
Performance Based Recruiting™ means that the employer only pays WorkGiant when they successfully hire you. This payment is largely based on the honor system; however, our technology is capable of detecting companies that try to avoid the fee.

While payment is absolutely not your responsibility, we do ask that you assist WorkGiant by reporting your hire. Please keep in mind companies that are willing to be unethical with WorkGiant probably operate in this manner on a day to day basis. Dishonest activity should be considered a red flag, if they are dishonest with us, they will probably be dishonest with you also. We believe that very few companies will try to avoid the fee but a few bad apples can harm the effectiveness of the site.

POTENTIAL FEE AVOIDING ACTIVITIES:
Below is a list of activities client companies may use to try to avoid paying WorkGiant fees:
• Redirecting you to another job that is not listed on the site.
• Directing you to a corporate website to apply.
• Reporting a lower salary.
• Side deals designed to lower your reported compensation.

E-JOB OFFER LETTERS: (ELECTRONIC-JOB OFFER)
All hiring companies using WorkGiant.com are required to issue an Electronic Offer letter as a letter of intent when proposing to hire a prospective candidate. The Electronic Job Offer letter must be made through the WorkGiant Website.

NO WARRANTIES:
WorkGiant.com does not warrant that the site or services will meet user requirements, or that the site or services will be uninterrupted or error-free or that defects in the site will be corrected. The site, the content and services made available on the site are provided on an "as is" and "as available" basis.

NO GUARANTY OF RESULTS:
WorkGiant.com makes no representations or guarantees regarding the effectiveness or timeliness of the Site in meeting the employment objectives of client companies. The site does not guarantee that Jobs posted by Companies will result in candidates being hired. WorkGiant.com is not a recruiting firm or an employment agency.

INTELLECTUAL PROPERTY:
The site contents are the sole property of WorkGiant.com and are protected by U.S. copyright and trademark laws and federal and international copyright and trademark laws. You may not decompile, disassemble, display, distribute the content, distributed, license, modify, reprint, reproduce, republished, reverse engineer, sell or transmit any portion of the content in any form without the express written permission of WorkGiant.com.

This includes copying the "look" and "feel" of the site, or adapting the HTML code used by the Site. You may print and download portions of material from different areas of the Site solely for your personal non-commercial use or your non-commercial use within your organization or as otherwise permitted. BINDING AGREEMENT:
By clicking on the, "I Agree Button" your electronic signature binds your company to our Terms and Conditions. Our Terms and Conditions form a binding agreement between you and WorkGiant.com, LLC. Any access to or use of the Site, indicates your acceptance of these Terms and Conditions. After accepting the WorkGiant Terms and Conditions in consideration of your use of the Site you represent that you are authorized on behalf of your company to form a legally binding contract with WorkGiant.com.

ACCOUNT TERMINATION:
WorkGiant.com may issue a warning, suspend or terminate a company’s access to the Site for breach of this Agreement, or if we are unable to verify or authenticate any information you provide to us. WorkGiant also reserves the right to delete all of your postings from this Web Site if your account is terminated. You may terminate your account by emailing us at termination@WorkGiant.com.

PASSWORD CONFIDENTIALITY:
You are responsible for maintaining the confidentiality of your Password and Account Number, and are fully responsible for all activities that occur under your account number and password.

NON-TRANSFERABILITY NON DISCLOSURE:
You agree that your WorkGiant.com account is non-transferable. You agree that your company or any of its representatives will not disclose any account information to any third party recruiters or other non member companies, etc.

POSTING JOBS:
WorkGiant.com clients can post an unlimited number of jobs for FREE!

JOB SEEKER/CANDIDATE REDIRECTION: ("Fee Avoidance") Companies agree not to redirect job seekers or candidates to company websites to view jobs/open positions that are not posted on WorkGiant.com by any method including e-mail, verbal or otherwise. All redirection of candidates will be construed as an act of "Fee Avoidance". Companies doing so would in effect make WorkGiant.com a conduit to their corporate website and an aggregator of Job Seeker traffic. Companies caught redirecting job seekers to avoid paying WorkGiant fees will be banned from the site.

SALARY RANGE:
Companies must have a salary range on all open positions. Salary ranges must be accurate and reasonable.

VIEWING RESUMES:
Using the WorkGiant Resume Database is strictly for employers who are in search of candidates. Sending unsolicited mail or Email, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services is strictly prohibited. Resume Database information is not for resale or to be used to promote products or services of any kind.

WorkGiant will give your company full access to our resume database.
After finding a resume of interest, initial contact will be made via the WorkGiant web system.

E-JOB OFFER LETTERS: (ELECTRONIC JOB OFFER)
All hiring companies using WorkGiant.com are required to issue an Electronic Job Offer letter as a letter of intent when proposing to hire a prospective candidate. The Electronic Job Offer letter must be made through the WorkGiant Website. Electronic Job Offer letters are regarded as tentative, until the offer is accepted by the Job Seeker through WorkGiant.

PAYMENT FEES FOR PERMANENT HIRES:
The permanent hire referral fee on WorkGiant.com is 1% of the hire's annual salary.

PAYMENT FEES FOR CONTRACT HIRES:
Contract hire fees will be a flat fee of $250.00 from $1-25 dollars an hour.
From $26 dollars an hour up to $200.00 dollars an hour, multiply the hourly rate times x $10.00 dollars.

HONESTY POLICY:
With WorkGiant.com employers win because they only pay the site upon hiring a qualified candidate. If a client company does not hire a candidate from the site, they DO NOT PAY! Employers have absolutely no downside! Our clients can post an unlimited number of jobs for free, and search our entire resume database for free.

All we ask is that our client companies have the integrity to be honest, and report the hires they make off the site. In times of corporate disregard for ethics and the law, corporate scandal, insider-trading, and fraudulent activities; WorkGiant stands as a light on a hill showing faith in the overall honesty of the business community.

PAYING WORKGIANT:
Member companies agree to pay WorkGiant.com within three business days of an offer letter being accepted by the candidate of choice. Payments may be in the form of any Major Credit Cards, PayPal, Company Check, Money Order, Wire Transfer, etc.

WORKGIANT GUARANTEE:
WorkGiant Guarantees the hire for a period of 30 Days for employee hires and 15 days for contract hires after the start date. If the Employee is terminated or resigns WorkGiant will issue a system credit only which can be used for payment of your next hire only.

SYSTEM OUTAGES:
WorkGiant.com periodically schedules system downtime for maintenance and other purposes. Unplanned system outages also may occur. WorkGiant.com shall have no liability whatsoever for the resulting unavailability of the Site or for any loss of data or transactions caused by planned or unplanned system outages or the resultant delay, delivery, no delivery of information caused by such system outages, or any third party acts or any other outages of web host providers or the Internet infrastructure and network external to the Site.

INTERNET RISK:
You assume total responsibility and risk for your use of the site and the internet. You acknowledge and agree that any uploads or transmissions you make may be intercepted and used by an unauthorized third party and that all of the risk associated therewith is solely yours.

LIMITATION OF LIABILITY:
Under no circumstances shall WorkGiant.com OR any other party involved in creating, producing, or distributing the site be liable for any direct, indirect, incidental, special, or consequential damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages) that result from (i) the use of or inability to use the site (ii) the cost of procurement of substitute merchandise or services resulting from any merchandise, data, content or services purchased or obtained or transactions entered into through or from the site; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the site; or (v) any other matter relating to the site. you hereby acknowledge that this paragraph shall apply to all content, merchandise, and services available through the site. In no event shall WorkGiant’s total cumulative liability under these terms exceed the lesser amount of any fees paid, if any to WorkGiant.com for the use of the site by you, or $50. Because some states may not allow the exclusion or limitation of liability for consequential or incidental damages, in such states liability is limited to the least amount permitted by law. The limitations of liability provided in this agreement apply to the workgiant.com, our parent company, affiliates, subsidiaries, and to all of our respective officers, directors, employees, attorneys and independent agents.

Registration Data and certain other information about you is subject to our Privacy Policy.

TRADEMARK INFORMATION:
Without WorkGiant’s prior permission, you agree not to display or use in any manner, WorkGiant’s Logos, Trademarks or Copyrights on your website or Homepage.

SEVERABILITY:
In the event that one or more portions of this Agreement shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, such validity, illegality or unenforceability shall not affect any other provision contained in this Agreement.

GOVERNING LAW:
This Agreement and access to the Site shall be governed by and construed in accordance with the law of the State of Florida, exclusive of its choice of law rules and matters affecting copyrights, trademarks and patents under U.S. federal law.

USER FEEDBACK:
Should any User respond to WorkGiant.com with information including feedback, such as questions, requests, opinions, comments, suggestions regarding the content of WorkGiant.com, such information shall be deemed to be non-confidential.

ENTIRE AGREEMENT, UPDATES AND MODIFICATIONS:
This Agreement and any documents expressly incorporated by reference constitute the entire agreement between WorkGiant.com and you pertaining to the subject matter hereof.

We encourage you to review this Agreement periodically for any updates or changes.
